Terms And Conditions For Employeye
Effective Date: 01st May, 2025
These Terms and Conditions (“Terms”) govern your use of the EMPLOYEYE software and services (“Service”). By using EMPLOYEYE, you (“Client”, “User”, or “Your Clients and employees”) agree to be bound by Employeye’s Terms and Conditions.
It’s Important and mandatory to accept and adapt to these terms and conditions & Agree to our Privacy Policy in order to use the Employeye software and its services.
1. Ownership of the Product
EMPLOYEYE is a fully owned product of Verve Systems Pvt. Ltd. Any reference to “EMPLOYEYE”, “EMPLOYEYE (the domain and site)”, “Verve”, or “Verve Systems” in this agreement refers to Verve Systems Pvt. Ltd., And its product Employeye.
2. Acceptance of Terms
By accessing or using EMPLOYEYE, you confirm your agreement to these Terms. Continued use of the Service constitutes your ongoing acceptance.
3. Description of Service
EMPLOYEYE is an employee monitoring software that:
- Captures screenshots
- Working & Idle tracks using keystrokes and mouse activity
- Captures usage data
- Generates productivity reports
The software is available in both free and paid subscription plans.
4. License to Use the Software
a. Grant of License
You are granted a non-exclusive, non-transferable, revocable license to use the software solely for your internal business purposes.
b. Restrictions and Limitations of Employeye software.
You may not:
- Reproduce, modify, or distribute the software
- Reverse engineer any part of the software
- Use the brand “EMPLOYEYE” without written consent from Verve Systems Pvt. Ltd.
- Use the software unlawfully or monitor employees without appropriate consent from the user
5. Plans and Usage Terms
Pricing details can be found at https://dev.employeye.com/pricing/, and may change from time to time without prior notice.
a. Free Plan
By using the free plan, you:
- Agree to allow EMPLOYEYE to collect and share aggregated, anonymized productivity and usage data with third parties for marketing, research, and product enhancement
- Understand that the plan may include limited features and possibly advertisements too in current or future version of the product.
b. Paid Plan
- Paid plans come with enhanced privacy, advanced features, and data protection.
- Data is not shared with third parties except as required for providing the Service (for example, but not limited to, Payment Processing Gateway).
- Discounts, if applicable, can be withdrawn or modified at EMPLOYEYE’s discretion.
6. Data Usage & Storage
a. Ownership
Clients retain ownership of their data unless explicitly specified in other sections of this document and its associated agreements.
b. Usage Rights
By using EMPLOYEYE, you grant Verve Systems Pvt. Ltd. the right to process and analyze your data to deliver services, improve the software, and generate reports. In free plans, anonymized data may be used for commercial research.
c. Storage Duration
- Screenshots and related activity logs will be retained as per your selected plan and Terms.
- All other data related to time, activity and other performance tracking with get automatically deleted without any backup, 90 days from the date it has been collected.
- Irrespective of the Package plan, all flagged screenshots along with it’s flagged parameters and without the user details will be retained and may be used by Verve for further product enhancements and improving product coding, logic, Architecture and software enhancements. Verve reserves all rights to use the flagged screenshots for an unspecified tenure.
7. S3 Storage Options
- Some paid packages allow companies to use their own Amazon S3 storage. In such cases, it is the Client’s responsibility for the data backup and deletion.
- Once the client opts out of EMPLOYEYE S3 usage by using their own S3 Account, then this cannot be switched back.
- Employeye would not be liable for the data captured on client’s S3 server.
8. Billing and Invoicing
All invoices will be generated and issued by Verve Systems Pvt. Ltd. following the receipt of payment. Payments are handled securely via third-party payment processors.
9. Account Deletion
You may request deletion of your company account at any time.
However:
- Verve will retain billing, financial, and legally required data
- Flagged screenshots and related parameters may also be retained
10. Shipping Policy
Upon successful payment, you will receive:
- A welcome/introduction email
- Admin Panel credentials
- Links and instructions to download the EMPLOYEYE application and configure your setup
11. Cancellation & Refund Policy
EMPLOYEYE does not offer cancellation or refunds once the service is purchased or the account is deleted, under any circumstances.
12. Termination
Verve reserves the right to suspend or terminate access for violations of these Terms. You may also terminate your account at your discretion, though payment obligations remain due.
13. Limitation of Liability
EMPLOYEYE is provided “as is” digital product. To the maximum extent permitted by law, Verve Systems is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Service.
14. Indemnification
You agree to indemnify and hold harmless Verve Systems Pvt. Ltd. and its affiliates from any claims, liabilities, or expenses arising from:
- Your use of the Service
- Violation of these Terms
- Infringement of third-party rights
15. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. All disputes are subject to the jurisdiction of courts located in Ahmedabad, Gujarat, India.
16. Modifications to Terms
Verve reserves the right to amend these Terms at any time. Changes will be communicated via website or email, and continued use constitutes your agreement to the updated Terms.
